What is the time frame for the Court to decide if it will take the case? Is it possible for them to reverse the appeals court without taking the case, without comment?

So the comments have gotten well off-track from what Dave's original post was all about? Maybe that was not exactly an accident.

What was the post about? Oh yeah, the NRA's petition for cert. in one of the 7th Circuit cases just decided. Obviously, Dave considers that as very important. He did considerable research in the public prints for the article cited in the petition to the Surpeme Court.

I suggest that everyone interested in the Second Amendment and incorporation of its protections against the states read the petition for cert. from the NRA. It is very informative!

Scalia wrote that the second amendment is an individual right vis a vis the federal government but that it should not be applied to the states. That was in his book titled "A Matter of Interpretation" published in 1998.

Is there any indiciation that he has changed his mind, other than the vague footnote in Heller?
